The veteran band, which is now without one of its founding members, has filed a lawsuit to compel Mars to participate in the arbitration in the hopes of obtaining a finding that he is formally a member or shareholder, along with any rights that those roles bestow.
According to Variety’s reporting, their argument is that his announcement that he will stop touring should be interpreted as a resignation.
Mick Mars, who is 71 years old, filed a countersuit, arguing that he did not give up anything when he announced the previous fall that the consequences of his long-term arthritic ailment left him no longer ready for the road. He claimed that he did not give up anything at all.
